§ 1 Terminologie

Die BBC Veranstaltungs GmbH, Prinzenstr. 85 B, 10969 Berlin wird nachfolgend ‘Bechstein Network‘ genannt.

Die von Bechstein Network angebotenen Mietobjekte (= Räumlichkeiten und Standorte der BBC Veranstaltungs GmbH) werden nachfolgend ‘Location’ genannt.

Mieter der Locations von Bechstein Network und Auftraggeber von Bechstein Network werden nachfolgend ‘Kunde’ genannt.

Bechstein Network und Kunde werden gemeinsam ‘Parteien’ genannt.

Dritte, die durch bestehende Vereinbarungen mit Bechstein Network ein gemeinsames Unternehmensziel verfolgen, werden nachfolgend ‘Partner’ genannt.

§ 2 Anwendungsbereich

Für alle Verträge zwischen Kunde und Bechstein Network gelten ausschließlich diese Allgemeinen Geschäftsbedingungen, sofern nicht zwischen den Parteien etwas anderes schriftlich vereinbart wird.

Die Geschäftsbedingungen des Kunden sind nicht Vertragsbestandteil, sofern die Geschäftsführung von Bechstein Network nicht der Geltung der Geschäftsbedingungen des Kunden ausdrücklich schriftlich zustimmt.

§ 3 Aufgaben und Pflichten des Kunden, Sorgfaltspflicht, Sicherheit, Schäden

Der Kunde trägt dafür Sorge, dass die ihm von Bechstein Network überlassenen Locations einschließlich der darin befindlichen Einrichtungen schonend und pfleglich behandelt und in einem sauberen Zustand gehalten werden.

Der Kunde hat Bechstein Network oder deren Partner über auftretende Mängel der Location unverzüglich zu informieren. Schäden der Location einschließlich der darin befindlichen Einrichtungen oder eine Beeinträchtigung der Sicherheit der Location sind vom Kunden unverzüglich Bechstein Network oder ihren Partnern anzuzeigen.

Bei bestehender Gefahr hat der Kunde die zur Vermeidung eines Schadenseintritts oder zur Verminderung der Schadensfolgen erforderlichen Maßnahmen unverzüglich selbst zu veranlassen.

Verstößt der Kunde gegen die vorstehenden Informations- und Anzeigepflicht oder unterlässt er die zur Vermeidung eines Schadenseintritts bzw. der Schadensfolgen erforderlichen Maßnahmen, so ist er zum Ersatz des daraus entstehenden Schadens verpflichtet.

§ 4 Werbung

Werbeeinrichtungen, Schilder, Transparente etc. dürfen vom Kunden innerhalb und außerhalb der Location nur nach vorheriger schriftlicher Zustimmung durch Bechstein Network angebracht werden. Sie sind vom Kunden nach Beendigung der vereinbarten Nutzungsdauer auf eigene Kosten und rückstandslos zu entfernen.

Der Kunde übernimmt die Verantwortung für alle von ihm oder in seinem Auftrag von Dritten geschriebenen, gedruckten und digitalen Werbungen betreffend die vom Kunden in der Location durchgeführte Veranstaltung.

Wirbt der Kunde für oder mit der Location von Bechstein Network, so sind die Werbemaßnahmen vorab und schriftlich von Bechstein Network freizugeben.

§ 5 Gesetzliche Vorschriften, behördliche Genehmigungen und Anordnungen, Haftung, Versicherung

Der Kunde hat bei Nutzung der Location die einschlägigen gesetzlichen Bestimmungen, insbesondere die Lärmschutzverordnung, sowie die einschlägigen Unfallverhütungsvorschriften zu beachten und einzuhalten.

Der Kunde hat die für die Nutzung der Location maßgeblichen gewerberechtlichen, ordnungsbehördlichen und feuerpolizeilichen Vorschriften sowie die Vorgaben der Gesetze über den Jugendschutz in eigener Verantwortung zu beachten und einzuhalten.

Es obliegt dem Kunden die für eine beabsichtigte Nutzung der Location erforderlichen behördlichen Genehmigungen und Konzessionen auf eigene Kosten einzuholen, für deren Aufrechterhaltung während der Nutzungsdauer zu sorgen und Anordnungen der Ordnungsbehörden, auch wenn sie nachträglich erfolgen, zu erfüllen. Der Kunde hat Bechstein Network die erforderlichen behördlichen Genehmigungen und Konzessionen auf Verlangen rechtzeitig vor Veranstaltungsbeginn nachzuweisen.

Der Kunde ist verpflichtet, für die Nutzungsdauer und den Nutzungszweck dienliche Versicherungen abzuschließen. Hierzu zählen insbesondere eine Betriebs- und Veranstalterhaftpflichtversicherung mit angemessenem Deckungsschutz, wobei die Versicherungsleistungen mindestens 5 Millionen Euro für Personen- und mindestens 1 Million Euro für Sach- und Vermögensschäden betragen müssen.

Die Versicherungspflicht des Kunden besteht nur für die Risiken, die zu wirtschaftlich zumutbaren Konditionen versicherbar sind. Die Versicherung ist während der gesamten Laufzeit des Vertragsverhältnisses aufrechtzuerhalten und Bechstein Network auf Anforderung nachzuweisen.

Der Kunde ist zur Einhaltung sämtlicher öffentlich-rechtlicher und Location-bezogener Vorschriften, insbesondere in Bezug auf die Bestimmungen der Lärmschutzverordnung, verpflichtet. Ordnungsgelder aufgrund der Nichteinhaltung der Vorschriften sind vom Kunden zu tragen. Schäden und Folgeschäden aufgrund der Nichteinhaltung der Vorschriften sind vom Kunden zu ersetzen.

Der Kunde übernimmt mit Übergabe der Location bis zur Rückgabe der Location die Verkehrssicherungspflichten und stellt Bechstein Network von etwaigen Ansprüchen Dritter aufgrund einer Verletzung der Verkehrssicherungspflichten in Bezug auf die von ihm genutzten Räumlichkeiten und Einrichtungen frei.

§ 6 Übergabe und Rückgabe der Location; Aufbau und Abbau

Bei Übergabe und Rückgabe der Location an den Kunden ist jeweils ein Protokoll anzufertigen. In diesem sind insbesondere der „Ist-Zustand“ der Location, übergebene Schlüssel, etwaige Beanstandungen des Kunden und ggf. bestehende Mängel sowie Fristen zu deren Beseitigung zu vermerken. Das Protokoll ist von den Vertragsparteien zu unterzeichnen.

Der Kunde hat die Zeit für Auf- und Abbauarbeiten ausreichend zu bemessen, sodass die Arbeiten vollständig und gefahrlos durchgeführt werden können. Termine für die Arbeiten sind ablauforganisatorisch zu koordinieren und, unabhängig von vertraglich festgelegten Auf- und Abbauzeiten, rechtzeitig mit Bechstein Network abzustimmen.

Der Kunde ist ohne Absprache mit Bechstein Network nicht berechtigt, in Fußböden, Wänden, Decken etc. der Location, Nägel einzuschlagen, Schrauben anzubringen und/oder sonstige Bauelemente und Einrichtungen mit der Location fest zu verbinden sowie die Location oder Teile der Location dauerhaft zu verändern, z. B. zu streichen.

Der Kunde ist verpflichtet, die Location nach Beendigung der Nutzung im ursprünglichen Zustand gemäß Übergabeprotokoll geräumt und vollständig gereinigt an Bechstein Network herauszugeben. Der Kunde ist verpflichtet, sämtliche von ihm und/oder von ihm beauftragten Dritten eingebrachten Sachen, gleich welcher Art, insbesondere Aufbauten und Einrichtungen unmittelbar nach Beendigung des Nutzungszeitraums zu entfernen. Eigene Verkabelungen, Reklameanlagen und Werbeschilder sind zu beseitigen. Mit Genehmigung von Bechstein Network durchgeführte Umbauten sind zu entfernen und der ursprüngliche Zustand ist wiederherzustellen, soweit hierzu keine anderen schriftlichen Vereinbarungen zwischen den Parteien getroffen wurden.

Nach vereinbartem Nutzungsende werden vom Kunden zurückgelassene Gegenstände von Bechstein Network auf Kosten des Kunden entsorgt. Bechstein Network behält sich vor, eine angemessene Gebühr für die Zwischenlagerung der Gegenstände zu erheben.

Vom Kunden verursachte Schäden werden von Bechstein Network in Rechnung gestellt und / oder auf Kosten des Kunden behoben.

Der Kunde hat dafür Sorge zu tragen, dass sämtlicher Abfall/Müll bis zum Ende des Nutzungszeitraums umweltgerecht entsorgt wird. Nach Ablauf des vereinbarten Nutzungszeitraums wird zurückgelassener Abfall/Müll von Bechstein Network auf Kosten des Kunden entsorgt.

§ 7 Ausstattung

Der Umfang der durch den Kunden eingebrachten Ausstattung (z.B. Auf- und Einbauten, Maschinen, Geräte, Möbel, Dekorationsmaterialien, etc.) ist vorab mit Bechstein Network schriftlich abzustimmen.

Die Ausstattung darf nur unter Einhaltung bestehender gesetzlicher Sicherheitsvorschriften eingebracht und errichtet werden, insbesondere muss sie den Location-abhängigen Brandschutzbestimmungen entsprechen.

Durch das Einbringen der Ausstattung dürfen Zu- und Ausgänge sowie Rettungswege weder verstellt, verhängt oder sonst in ihrer Funktion eingeschränkt werden. Das Über- oder Abdecken von Sicherheitsbeleuchtungen und Piktogrammen ist untersagt. Bewegungs- und Stellflächen für Einsatz- und Rettungsfahrzeuge sind ebenso wie Feuerlösch-, Feuermelde- und Alarmeinrichtungen jederzeit freizuhalten.

Aufbauten, Dekorationen, Beleuchtungs- und sonstige Geräte müssen in fachmännischer Ausführung erstellt, tragfähig und standsicher sein. Der Kunde trägt dafür Sorge, dass geltende Sicherheitsbestimmungen eingehalten werden, insbesondere Verletzungen Dritter z. B. durch Splitter, scharfe Kanten, herunterfallende Geräte und Bauten ausgeschlossen werden.

Die Verwendung von offenem Feuer und Licht oder feuergefährlichen Stoffen ist nicht gestattet. Ausnahmen bedürfen einer schriftlichen Vereinbarung zwischen dem Kunden und Bechstein Network.

Gefährliche szenische Aufführungen, insbesondere die Verwendung von artistischen Geräten und die Mitnahme und das Mitwirken von Tieren, sind abzusprechen und bedürfen einer gesonderten schriftlichen Vereinbarung zwischen dem Kunden und Bechstein Network.

§ 8 Organisationsmanagement und Durchführung von Veranstaltungen und Produktionen

Der Kunde trägt die alleinige Verantwortung für den ordnungsgemäßen und störungsfreien Ablauf der von ihm in der Location durchgeführten Veranstaltungen bzw. Produktionen.

Der Kunde sorgt für ein qualifiziertes Organisationsmanagement, in dem insbesondere Anordnungs- und Entscheidungsrechte klar geregelt sind. Der Kunde hat spätestens eine Woche vor der Veranstaltung Bechstein Network eine*n Verantwortliche*n zu benennen, der / die vor, während und nach dem Nutzungszeitraum erreichbar ist und auf die Einhaltung der vertragsgemäßen Nutzung der Location achtet.

Der Kunde ist für die Eignung des von ihm eingesetzten Personals verantwortlich und hat für den notwendigen Umfang an geeigneten Fachkräften, insbesondere für die von ihm genutzten Maschinen und Geräte, Sorge zu tragen.

Der Kunde hat ausschließlich geeignete, insbesondere erfahrene und zuverlässige volljährige Personen mit der Bedienung bühnentechnischer Einrichtungen, Beleuchtungs-, Ton-, Medien- und Maschinenanlagen zu beauftragen.

Bechstein Network ist berechtigt, den Austausch von Mitarbeitern des Kunden und im Auftrag des Kunden tätigen Dritten zu verlangen, soweit hierfür ein nachvollziehbarer sachlicher Grund, insbesondere der Verdacht der Nichteignung bzw. eines Fehlverhaltens vorliegt.

Bechstein Network arbeitet mit erfahrenen Partnern für Ausstattung, Gastronomie, Catering, Personal sowie für die Technik zusammen, welche die Location kennen. Ist zwischen Kunde und Bechstein Network nichts anderes vereinbart, arbeitet der Kunde mit diesen Partnern zusammen. Werden die Partner nicht beauftragt, kann ein Nutzungsentgelt fällig werden, da z. B. die eingebaute Lichttechnik den Partnern gehört.

§ 9 Erbringung von Dienstleistungen

Erbringt Bechstein Network über die Vermietung der Location hinaus Dienstleistungen für den Kunden, so sind Art und Umfang der Dienstleistung vorab schriftlich abzustimmen.

Für Dienstleistungen, die von Partnern von Bechstein Network für den Kunden erbracht werden, übernimmt Bechstein Network keine Haftung und Gewährleistung. Für Art und Umfang der Dienstleistung sind alleine die Partner verantwortlich.

Grundlage der Dienstleistungen ist das jeweils von den Parteien unterschriebene letzte Angebot sowie etwaige Nachtragsangebote.

Nach Unterzeichnung des Angebots vereinbarte Zusatzleistungen werden von Bechstein Network spätestens eine Woche vor der Veranstaltung dem Kunden mit allen Zusatzkosten angemeldet. Aufgrund der Kurzfristigkeit muss der Kunde mögliche Fehler unverzüglich an Bechstein Network zurückmelden.

§ 10 Verwahrung von Wertsachen und Garderobe

Bechstein Network übernimmt keine Haftung für Wertsachen, Bargeld, Garderobe und andere Gegenstände, welche vom Kunden, seinen Mitarbeitern, seinen Beauftragten, etwaigen Untermietern, Besuchern oder sonstigen Dritten in die Location mitgebracht werden.

Der Kunde hat für eine entsprechende Versicherung vorgenannter Gegenstände selbst Sorge zu tragen.

Der Kunde und die Bechstein Network können über die Verwahrung von Wertsachen und Garderobe während einer Nutzung der Location eine gesonderte schriftliche Vereinbarung treffen.

§ 11 Nutzungsänderung, Untervermietung, sonstige Gebrauchsüberlassung

Die Location darf vom Kunden ausschließlich zum vertraglich vereinbarten Zweck und für die vertraglich festgelegte Dauer genutzt werden. Eine Änderung oder Erweiterung der Nutzung bedarf der ausdrücklichen schriftlichen Zustimmung von der Bechstein Network.

Eine, auch nur teilweise, Untervermietung oder sonstige Gebrauchsüberlassung an Dritte ist nur mit ausdrücklicher schriftlicher Zustimmung von Bechstein Network gestattet.

Im Falle der Untervermietung oder sonstigen Gebrauchsüberlassung hat der Kunde für das Verhalten des Untermieters oder desjenigen, dem er den Gebrauch der Location überlassen hat, wie für eigenes Verhalten gegenüber Bechstein Network einzustehen.

§ 12 Gewährleistung

Die Übergabe der Location an den Kunden erfolgt nach eingehender Besichtigung durch den Kunden. Bei Übergabe ist ein Protokoll anzufertigen, in dem insbesondere der „Ist-Zustand“ der Location, dem Kunden übergebene Schlüssel, etwaige Beanstandungen des Kunden zu vermerken sind. Der Kunde bestätigt mit Übergabe der Location, dass sich diese im vertragsgemäßen Zustand befindet, soweit im Protokoll keine Beanstandungen des Kunden bzw. Mängel der Location vermerkt sind. Das Protokoll ist von den Parteien zu unterzeichnen.

Mängel, die die Tauglichkeit der Location zu dem vertragsgemäßen Gebrauch mindern, berechtigen den Kunden nur dann zu einer Minderung oder einer Zurückhaltung des vereinbarten Nutzungsentgeltes, wenn er den Mangel gegenüber der Bechstein Network nach Art und Umfang unverzüglich angezeigt hat und die Bechstein Network trotz angemessener Fristsetzung mit der Beseitigung des Mangels in Verzug ist.

§ 13 Sicherheit

Die Anzahl des notwendigen Einlass- und Sicherheitspersonals wird insbesondere durch die Art der vom Kunden durchgeführten Veranstaltung bzw. Produktion, durch die Anzahl der teilnehmenden Personen, durch potenzielle Veranstaltungsrisiken und durch ggf. zusätzliche Anforderungen der Bau- und Ordnungsdienstbehörden bestimmt und auf dieser Grundlage von Bechstein Network für den Kunden verbindlich festgelegt.

Der Kunde hat auf Verlangen von Bechstein Network ein Sicherheitskonzept für die von ihm durchgeführte Veranstaltung bzw. Produktion vorzulegen. Sollte das Konzept unzureichend sein, insbesondere nicht den üblichen Standards entsprechen, behält sich Bechstein Network vor, das Vertragsverhältnis zu kündigen, wenn der Kunde trotz Aufforderung keine Nachbesserung vornimmt bzw. Abhilfe schafft. In diesem Fall verpflichtet sich der Kunde zu Schadenersatzzahlungen in Höhe der Stornierungskosten, vgl. § 17.

Besteht nach Prüfung des Sicherheitskonzepts des Kunden, auch während der Veranstaltung, noch zusätzlicher Bedarf zur Sicherung des Anwesens, in dem sich die Location befindet, und / oder eines Nachbaranwesens, und / oder der Veranstaltung, behält Bechstein Network sich das Recht vor, zusätzliches Sicherheitspersonal zur Gefahrenabwehr zur Verfügung zu stellen. Die hierfür weiter anfallenden Kosten sind vom Kunden zu tragen.

§14 Schlüssel der Location; Zutritt zur Location

Dem Kunden werden von Bechstein Network Schlüssel oder Zugangscodes für die Location in Abhängigkeit von der Art der von Kunden durchgeführten Veranstaltung bzw. Produktion überlassen.

Die Übergabe der Schlüssel an den Kunden ist in einem Protokoll festzuhalten, das von den Parteien zu unterzeichnen ist.

Die Anfertigung zusätzlicher Schlüssel oder Kopien ist dem Kunden ohne vorherige schriftliche Zustimmung von Bechstein Network strengstens untersagt.

Bei Verlust eines Schlüssels ist der Kunde verpflichtet, die Kosten für den Ersatz des Schlüssels oder den Austausch der Schließanlage zu tragen.

Der Kunde hat Bechstein Network und / oder Partnern nach vorheriger Abstimmung Zutritt zur Location, insbesondere zum Zweck der Überprüfung des Zustandes der Location und deren vereinbarungsgemäßen Nutzung durch den Kunden, zu gestatten.

§ 15 Betriebs-, Objektbetreuungs- und sonstige Nebenkosten; Nutzung von sanitären Einrichtungen der Location

Betriebs-, Objektbetreuungs- und sonstige Nebenkosten der Location sind nicht in der Miete enthalten, sofern die Parteien nichts anderes schriftlich vereinbart haben. Diese Kosten werden nach Beendigung der Nutzung von Bechstein Network gegenüber dem Kunden, unter Anrechnung etwaiger vom Kunden geleisteter Vorauszahlungen, gesondert abgerechnet.

Der Kunde trägt dafür Sorge, dass die sanitären Einrichtungen der Location (WCs, Abflüsse etc.) nur bestimmungsgemäß genutzt werden. Insbesondere ist es untersagt, Gegenstände gleich welcher Art (z.B. Zitronenschalen, Zigarettenkippen, Damenbinden) wegzuspülen. Im Falle einer Zuwiderhandlung hat der Kunde die Kosten für die Beseitigung etwaiger, hierdurch an den sanitären Einrichtungen verursachter Schäden sowie Folgeschäden zu tragen.

Der Kunde ist verpflichtet, die Kosten für von Bechstein Network zur Verfügung gestellten Verbrauchsmaterials (z.B. Hygieneartikel, Reinigungs- oder Desinfektionsmittel) zu tragen, sofern hierzu nicht anders schriftlich vereinbart wird.

§ 16 Haftung der Bechstein Network

Die verschuldensunabhängige Haftung von Bechstein Network – als Vermieter - der Location für bei Vertragsabschluss vorhandene Sachmängel der Location nach § 536a Abs. 1 BGB ist ausgeschlossen.

Für Sach- und Vermögensschäden des Kunden haftet Bechstein Network nur bei Vorsatz und grober Fahrlässigkeit, soweit der Mangel durch die Location bedingt ist und sich ein vertragsuntypisches Risiko realisiert.

Auch für das Verhalten seiner Vertreter oder Erfüllungsgehilfen haftet Bechstein Network nur bei Vorsatz oder grober Fahrlässigkeit.

Der Haftungsausschluss greift in den folgenden Fällen nicht ein:

wenn Bechstein Network eine bestimmte Eigenschaft der Location besonders zugesichert, oder einen Mangel der Location arglistig verschwiegen hat;

bei Verletzung von Leben, Körper oder Gesundheit des Mieters, die auf einer fahrlässigen Pflichtverletzung der Bechstein Network oder einer vorsätzlichen oder fahrlässigen Pflichtverletzung eines gesetzlichen Vertreters oder Erfüllungsgehilfen von Bechstein Network beruhen;

sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung der Bechstein Network oder eines gesetzlichen Vertreters oder Erfüllungsgehilfen der Bechstein Network beruhen;

wenn und soweit der Schaden auf einer Verletzung einer vertragswesentlichen Pflicht (Kardinalpflicht) von Bechstein Network beruht;

für Schäden, für die eine Versicherung von Bechstein Network besteht und die Bechstein Network hieraus tatsächlich Ersatz erlangen kann.

Im Falle einer Haftung der Bechstein Network für Sach- und Vermögensschäden ist diese auf den vertragstypischen und vorhersehbaren Schaden begrenzt. Dies gilt auch für entgangenen Gewinn und ausgebliebene Einsparungen. Die Haftung der Bechstein Network für Mangelfolgeschäden ist in diesen Fällen ausgeschlossen.

Im Falle technischer Störungen der gebäudetechnischen Anlagen, höherer Gewalt, Anordnungen seitens Behörden oder sonstiger Unmöglichkeit der Leistung kann vom Kunden keine Vertragserfüllung verlangt werden. Schadensersatzansprüche des Kunden gegenüber der Bechstein Network sind in diesem Fall ausgeschlossen, es sei denn, der Bechstein Network hat die Unmöglichkeit infolge grober Fahrlässigkeit zu vertreten.

§ 17 Kündigung

Die Parteien sind berechtigt, den Nutzungsvertrag aus wichtigem Grund fristlos zu kündigen. Ein wichtiger Grund liegt für Bechstein Network insbesondere vor, wenn

der Kunde seine vertraglichen Verpflichtungen nachhaltig verletzt (z.B. bei einer Nutzungsänderung ohne vorherige schriftliche Zustimmung der Bechstein Network, einem Verstoß gegen die vereinbarten Sicherheitsbestimmungen und –auflagen),

durch die vom Kunden geplante Veranstaltung bzw. beabsichtigte Produktion eine Störung der öffentlichen Sicherheit und Ordnung zu befürchten ist oder die Durchführung der Veranstaltung bzw. Produktion gegen geltende Gesetze bzw. behördliche Verfügungen und Auflagen verstößt bzw. dem Kunden hierfür erforderliche behördliche Erlaubnisse nicht erteilt werden. Dies gilt nicht, wenn nach Vertragsabschluss Gesetze oder behördliche Verfügungen und Auflagen zur Bekämpfung der CoViD-19- Pandemie erlassen werden, die eine Einschränkung des vereinbarten Nutzungszwecks der Location zur Folge haben. In diesem Fall steht den Parteien ein Anpassungsrecht des Mietvertrages gemäß den Bestimmungen des jeweiligen Mietvertrags zu.

die vertraglich vereinbarten Zahlungen durch den Kunden nicht oder nicht fristgerecht geleistet wurden.

Macht die Bechstein Network von dem Recht zur fristlosen Kündigung Gebrauch, so behält die Bechstein Network die Ansprüche auf Zahlung des vereinbarten Nutzungsentgelts und sonstigen Nebenkosten unter Anrechnung etwaiger ersparter Aufwendungen.

§ 18 Zahlungsbedingungen und Stornierung

Sofern nicht anders schriftlich vereinbart, gelten folgende Zahlungsbedingungen für die vereinbarten Leistungen der Bechstein Network und ihrer Partner:

Anzahlung in Höhe von 50% des vereinbarten Gesamtbetrags, fällig mit Vertragsunterzeichnung.

Zwischenzahlung in Höhe von 40 % des vereinbarten Gesamtbetrags, fällig 14 Tage vor Beginn der Nutzung der Location durch den Kunden bzw. vor Leistungserbringung durch die Bechstein Network oder ihre Partner.

Schlusszahlung in Höhe der verbliebenen 10 % des vereinbarten Gesamtbetrags sowie etwaiger zwischen den Parteien vertraglich vereinbarte Zusatzleistungen sowie zusätzlich entstandener Kosten, die gem. diesen AGB vom Kunden zu tragen sind, nach Abrechnung durch Bechstein Network nach der Nutzung der Location.

Entscheidend für die fristgerechte Zahlung ist der Zahlungseingang bei Bechstein Network.

Es gelten folgende Bedingungen für die Stornierung von Leistungen, die der Kunde mit der Bechstein Network vereinbart hat.

Die Stornierung durch den Kunden hat schriftlich zu erfolgen.

Die Stornierungskosten betragen:

20% des vereinbarten Gesamtbetrages (Miete und sonstige nicht nach tatsächlichem Verbrauch abgerechnete Kosten) bei einer Stornierung bis 6 Monate vor dem vereinbarten Leistungszeitraum (Beginn des Miet- bzw. Nutzungsverhältnisses),

40% des vereinbarten Gesamtbetrages (Miete und sonstige nicht nach tatsächlichem Verbrauch abgerechnete Kosten) bei einer Stornierung bis 3 Monate vor dem vereinbarten Leistungszeitraum (Beginn des Miet- bzw. Nutzungsverhältnisses),

60% des vereinbarten Gesamtbetrages (Miete und sonstige nicht nach tatsächlichem Verbrauch abgerechnete Kosten) bei einer Stornierung bis 1 Monat vor dem vereinbarten Leistungszeitraum (Beginn des Miet- bzw. Nutzungsverhältnisses),

80% des vereinbarten Gesamtbetrages (Miete und sonstige nicht nach tatsächlichem Verbrauch abgerechnete Kosten) bei einer Stornierung bis 1 Woche vor dem vereinbarten Leistungszeitraum (Beginn des Miet- bzw. Nutzungsverhältnisses) und

90% des vereinbarten Gesamtbetrages (Miete und sonstige nicht nach tatsächlichem Verbrauch abgerechnete Kosten) bei einer Stornierung 1 Woche vor dem vereinbarten Leistungszeitraum (Beginn des Miet- bzw. Nutzungsverhältnisses).

Besteht der Kunde auf Leistungen von Dritten, die über Bechstein Network angeboten werden, so gelten deren Stornierungsbedingungen.

§ 19 Sonstiges

Der Kunde trägt die Kosten von etwaigen Nutzungslizenzen Dritter im Zusammenhang mit der Nutzung der Location und führt diese ab (z.B. GEMA). Der Kunde stellt die Bechstein Network von etwaigen Ansprüchen Dritter aufgrund einer Verletzung dieser Verpflichtung frei.

§ 20 Schlussbestimmungen

Änderungen und Ergänzungen dieser Allgemeinen Geschäftsbedingungen bedürfen der Schriftform. Dies gilt auch für einen Verzicht auf das Schriftformerfordernis. Mündliche Nebenabreden bestehen nicht.

3. COLLECTION OF GENERAL DATA AND INFORMATION
The website of the Bechstein Network GmbH collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.

On the website of the Bechstein Network GmbH, users are given the opportunity to subscribe to our enterprise's newsletter. The input mask used for this purpose determines what personal data are transmitted, as well as when the newsletter is ordered from the controller.

The Bechstein Network GmbH informs its customers and business partners regularly by means of a newsletter about enterprise offers. The enterprise's newsletter may only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter shipping. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter shipping, for legal reasons, in the double opt-in procedure. 5. NEWSLETTER-TRACKING
The newsletter of the Bechstein Network GmbH contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. The website of the Bechstein Network GmbH contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.

7. ROUTINE ERASURE AND BLOCKING OF PERSONAL DATA
The data controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. e) Right of restriction of processing

Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.

The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use instead.

The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.

The data subject has objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR, the data subject shall have the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

g) Right to object
Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on point (e) or (f) of Article 6(1) of the GDPR.
